Terms of Service

These Terms of Service (the "Terms") govern your use of the Brainura mobile application, the marketing website at brainura.app, and any related services (collectively, the "Service") operated by Hanna Kravchenko ("Brainura", "we", "us", "our"). By installing, accessing, or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

2. The Service

Brainura provides cognitive-training exercises, personalised progress tracking, a Brain Age estimate, achievements, and an optional premium tier delivered via auto-renewing subscriptions. The Service is provided on an "as is" basis and may evolve over time. We reserve the right to add, modify, or remove features at our discretion.

3. Your account

Most of the Service can be used anonymously. If you choose to sign in, you are responsible for keeping your credentials safe and for activity on your account. Notify us immediately at krv4art.dev@gmail.com if you suspect unauthorised access.

4. Subscriptions and billing

4.1 Auto-renewing subscriptions

Brainura offers auto-renewable subscriptions to unlock premium features. The following terms apply, in line with the requirements of Apple App Store and Google Play:

• Payment will be charged to your Apple ID account (or Google Play account) at confirmation of purchase.
• Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the cost of the chosen plan.
• Subscriptions may be managed by you and auto-renewal may be turned off by going to your Account Settings on the App Store or Google Play after purchase.
• Any unused portion of a free trial period (if offered) will be forfeited when you purchase a paid subscription to that publication, where applicable.

4.2 Prices and currencies

Current subscription prices are displayed inside the app at the moment of purchase. Prices vary by country to reflect local taxes and purchasing-power adjustments. We may change prices for future renewals; you will be informed in advance through the App Store or Google Play in accordance with their policies.

4.3 Introductory and promotional offers

We may offer a one-time introductory price (e.g. a discounted first year) to new subscribers. Eligibility is determined by Apple or Google and is generally limited to users who have not previously subscribed to the relevant subscription group. Standard renewal pricing applies after the introductory period ends.

4.4 Refunds

All purchases are processed by Apple App Store or Google Play. Cancellation and refund requests must be submitted to the respective store:

• Apple: reportaproblem.apple.com
• Google: play.google.com/store/account

We do not directly process refunds. We will, however, share consumption data with Apple when permitted and at your request to help with legitimate refund decisions.

5. Acceptable use

You agree not to:

• Reverse-engineer, decompile, modify, or attempt to derive the source code of the Service.
• Bypass any technical limitations or attempt to obtain features beyond your current entitlement.
• Use the Service to upload or transmit any unlawful, harmful, or infringing content.
• Use automated tools, scrapers or bots to access the Service.
• Resell, sublicense, rent or otherwise commercially exploit the Service.
• Use the Service in any way that could damage, disable or impair its operation.

6. Intellectual property

All content, code, design, exercises, scoring logic, branding, and artwork within the Service are the property of Brainura or its licensors and are protected by copyright, trademark and other intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes.

7. User-generated content

Any optional feedback, ratings, or messages you submit through the Service (collectively, "User Content") remains yours. By submitting User Content, you grant us a worldwide, royalty-free licence to use, reproduce, and modify it solely to operate and improve the Service.

8. Disclaimer of warranties

Brainura is a wellness and entertainment product. It is not a medical deviceand is not intended to diagnose, treat, cure or prevent any disease, cognitive impairment or mental health condition. Results vary by individual and we make no claims about specific cognitive outcomes. Always consult a qualified healthcare professional for medical advice. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

9. Limitation of liability

To the maximum extent permitted by applicable law, Brainura shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service. Our total liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid to us in the 12 months preceding the claim, or USD 50, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Brainura and its affiliates from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

11. Termination

You may stop using the Service at any time by uninstalling the app and cancelling any active subscription via the App Store or Google Play. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. We will provide reasonable notice where practicable. Sections that by their nature should survive (such as intellectual property, disclaimers, limitations of liability) will continue to apply after termination.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced inside the app and at the top of this page at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

13. Governing law and disputes

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved by good-faith negotiation between the parties; if unresolved within 60 days, the dispute shall be submitted to the competent courts of Ukraine. Nothing in this section limits any non-waivable consumer rights you may have under your local law.
